State DNR board member wants review of guidance docs after lawsuit

A state Department of Natural Resources board member is asking agency officials for more information on how they put together guidance documents after a draft document helped spark a lawsuit.

The DNR’s guidance documents are formal written directions for staff that explain how to approach decisions when state law is unclear.

The Dairy Business Association sued the DNR in July alleging among other things that a draft guidance document improperly imposed new runoff regulations for large livestock farms. The agency settled the lawsuit last week.

Natural Resources Board member Greg Kazmierski directed agency officials Wednesday to review their guidance documents and inform the board how the documents are developed at its December meeting. He says the public doesn’t understand how the documents get drafted.
