Judge denies plea deal for man accused of hitting, killing student teacher
A judge denied a no-contest plea deal Monday for a man charged with hitting and killing a student teacher outside Wisconsin Heights High School in 2012.
Gary Lammert is charged with homicide by negligent operation of a vehicle. He’s accused of hitting 22-year-old Katie Binning’s car as she was about to turn into Wisconsin Heights High School.
Monday, a judge gave Lammert an ultimatum.
“Because a no-contest plea in my mind is not accepting responsibility, I don’t think it’s appropriate to have a no-contest plea in a case that’s…where the consequences of the loss has been so enormous,” Dane County Circuit Court Judge David Flanagan said.
Lammert has two weeks to consider whether or not to plead guilty to a misdemeanor or he will go to trial in August and he will face a felony charge.
