School bus driver arrested for drunken driving

5 children on bus during crash

WINONA COUNTY, Minn. - A Winona County Sheriff's deputy arrested a 54-year-old school bus driver for driving while intoxicated after a crash Tuesday evening. 

Deputies were called at about 5 p.m. to assist a school bus in a ditch in Winona County. A tow truck driver called to the scene told deputies they believed the driver of the school bus, Karl Allen Herber, of Rollingstone, had been drinking. 

Herber told authorities there were kids misbehaving on the bus and he looked back, told them to sit down and then went into the ditch. There were five children under the age of 16 on the bus at the time of the crash, according to the criminal complaint. Herber told authorities another bus picked them up. 


Herber's preliminary breath test showed alcohol concentration of .127. Herber was arrested and taken to the Winona County Law Enforcement Center. At about 6:30 p.m., Herber's State of Minnesota DataMaster DMT (breath) test record showed he had an alcohol concentration of .09. 

Herber was charged with third degree DWI-operating a motor vehicle while under the influence of alcohol; third degree DWI- operating a motor vehicle with an alcohol concentration of 0.08 or more within 2 hours; and third degree DWI- operating a commercial motor vehicle with an alcohol concentration of 0.04 of more within 2 hours.
