Suit alleges secretaries diverted millions from state recycling program
The city of Madison joined a lawsuit filed against officials at the state Department of Natural Resources and Department of Administration on Friday.
Madison is joining the city of Milwaukee, which is suing over the end of the statewide recycling program. The suit alleges secretaries Mike Huebsch and Cathy Stepp diverted millions from that program, which violates the state’s constitution.
The defendants allegedly took 40 percent of the recycling grant appropriation for other purposes, primarily through transferring the money to the general fund, according to the suit.
The suit argues by taking this money it’s turning it into an unconstitutional tax by “diverting regulatory recycling fee revenue for non-recycling purposes.”
Both Milwaukee and Madison city officials are asking for that money back and want a permanent injunction on this action.
