Madison Bar Owner Convicted For Violating Smoking Ban

Fines Range From $125 To $500

A Dane County supervisor and Madison bar owner was convicted on Friday of violating the city's smoking ban.

A municipal court judge ruled that Dave Wiganowsky didn't stop patrons from lighting up at his northeast side bar, Wiggie's.

Fines for non-compliance range from $125 to $500, WISC-TV reported.

The city's controversial smoking ban went into effect in July 2005, but continues to rally both supporters and opponents.

While proponents of the ban point to the passage of similar measures by states and local communities around the country in recent years, several local business owners said that they blame the ban for losses that have forced them to close their doors.

Last month, the Madison Planning Commission approved the construction of smoking decks at four Madison bars, including Wiggies's. Wiganowsky said that he has lost $150,000 since the ban went into effect. Some of his employees said that they are hoping a smoking deck can bring back some hope, WISC-TV reported.
