Convicted Killer Continues To Wait For DNA Results

Convicted killer Laurie Bembenek was in a California court Monday to file a lawsuit against Dr. Phil.

One year ago, Bembenek traveled to the "Dr. Phil" show in Hollywood to get results of DNA tests she hoped would exonerate her. Instead, she ended up losing her leg.

Monday morning, Bembenek and her California attorney filed suit against Dr. Phil and Paramount pictures. It alleges the celebrity psychologist knew Bembenek suffered from panic and posttraumatic stress disorders, yet confined her in a gated housing complex, without radio, TV, or telephone and was guarded by a Dr. Phil staff person around the clock.

Bembenek said the conditions prompted her attempt to escape out a window by sliding down a bed sheet.

"I had a panic attack. It felt like the walls were closing in on me because it felt just like prison again," Bembenek said.

Bembenek fell when the sheet snapped. Her right leg eventually had to be amputated.

Bembenek's suit does not specify a damage amount, but requests compensatory as well as punitive damages.

WISN 12 News forwarded a copy of the suit to Dr. Phil's staff, but it did not return the request for comment.

Dr. Phil was supposed to do a show on Bembenek's DNA tests, but that never happened -- in part because of the accident and also because, a year later, those DNA tests are still not completed.

Bembenek hopes the tests will be done by the end of this year.
