a judge accepts a controversial plea in a drunk driving
case, we'll have reaction from the family of the victim
A FORMER LUTHERAN BISHOP IS BACK IN JAIL.
AFTER ENTERING A GUILTY PLEA.
GOOD EVENING I'M MICHELLE LI.
-- ERIC --
AND I'M ERIC FRANKE.
THANKS FOR JOINING US.
BRUCE BURNSIDE TOOK RESPONSIBILITY IN COURT TODAY
FOR THE DEATH OF A JOGGER LAST APRIL...
NEWS THREE'S JESSICA ARP WAS AT THE PLEA HEARING TODAY.
A TRIAL HAD BEEN SCHEDULED TO START FOR BRUCE BURNSIDE
UNTIL A PLEA DEAL WAS REACHED LAST WEEK.
AN OUTCOME THE VICTIM'S FAMILY STILL DISAGREES WITH.
NAT is this what you'd like me to do today, enter
a plea and proceed as described by the laywers, yes
it is :47
A PLEA WAS WHAT BRUCE BURNSIDE WANTED...
NAT to that charge, what is your plea, guilty your
BUT KEVIN MENGELT.
LOOKING ON WITH HIS WIFE IN MIND...
SAYS IT STILL ISN'T WHAT HE WAS HOPING FOR
i thought the evidence was overwhelming and going
to court would allow all his misdeeds to be seen in
public and thats something i wanted :16
MENGELT'S WIFE MAUREEN WAS KILLED BY BURNSIDE ON APRIL
7TH LAST YEAR...
DRUNK BEHIND THE WHEEL.
HE CAREENED OFF A SUN PRAIRIE OFF-RAMP.
HITTING HER WHILE SHE WAS JOGGING.
A FORMER LUTHERAN BISHOP.
BURNSIDE WAS CHARGED WITH FOUR FELONIES.
INCLUDING HOMICIDE BY O-W-I AND HIT AND RUN.
it appears that there is some confusion within the
community as to why this agreement is appropriate
in this case :38
THE ASSISTANT DISTRICT ATTORNEY EXPLAINED THAT A SOBRIETY
TEST THROWN OUT BY A JUDGE.
AND QUESTIONS OVER THE CONSTITUTIONALITY OF A BLOOD
DRAW AFTER THE CRASH WAS WHAT LED TO A DEAL TO HAVE
BURNSIDE PLEAD TO 2ND DEGREE RECKLESS HOMICIDE AND
FIRST OFFENSE O-W-I.
this charge fits the facts of the case, the defendant
was acting recklessly when he caused the deatho f
maureen mengelt and by entering a plea today he admits
BURNSIDE'S ATTORNEY AND THE JUDGE.
he accepts responsibility as he has wanted to for
many months and in doing so provides closure and certainty
to eveyrone involved :52
WHICH IS MENGELT'S ONLY SOLACE.
if these facts are considered, and he is put in prison
accordingly i think that would help my family and
help the communtiy put trust again in our legal system
:32 droping these charges i thought was a sign of
BURNSIDE WAS TAKEN TO JAIL UNTIL SENTENCING...
WHICH HAS YET TO BE SCHEDULED.
THE D-A PLANS TO ASK FOR EIGHT YEARS IN PRISON ON
MENGELT SAYS THEY'RE HOPING THE JUDGE SEES THE OTHER
COUNTS AGAINST HIM.
AND DECIDES FOR MORE.
-- MICHELLE --
THANK YOU JESSICA.
