ATTORNEYS SAID THEY HAD AGREED TO A PLEA DEAL.
NATso he'd be pleading to 2nd degree reckless homicide
BURNSIDE WILL PLEAD GUILTY TO JUST ONE FELONY CHARGE.
AND MISDEMEANOR FIRST OFFENSE O-W-I.
to offer a plea deal at this level, this is just a
failure of our criminal justice system :32 they have
taken something from my family, they've hurt us so
severely, its taken so long, and then to see no real
justice the justice thats been offered is he'll go
to jail sooner
BUT BURNSIDE'S ATTORNEY SAYS THE DEAL IS BECAUSE OF
A JUDGE RULED BURNSIDE'S
FIELD SOBRIETY TEST WAS INADMISSABLE
HIS BLOOD TEST WAS.
BUT A SEPARATE CASE AT THE COURT OF APPEALS IS CHALLENGING
WHETHER THOSE BLOOD TESTS ARE LEGAL...
MEANING IF BURNSIDE PLEADED TO CURRENT CHARGES.
THE CASE COULD BE APPEALED FOR YEARS TO COME
this result gives us teh certainty of a conviction
and closure :12 and i hope the mengelt family will
be able to appreciate that in the end :18
BUT MENGELT SAYS IT MAKES HIM FEEL ENTIRELY DIFFERENT.
i think people in the public should ask themselves,
if he cant be convicted of a crime when its so clear,
how can they feel safe? how can they feel that justice
is going to be done ever :21
BURNSIDE WILL BE IN COURT NEXT TUESDAY TO MAKE HIS
THE PROSECUTOR SAID YESTERDAY SHE'D SEEK EIGHT YEARS
IN PRISON ON THE CHARGE...
