Teen Accused In Fatal Overdose Sentenced To Juvenile Facility

JANESVILLE, Wis. -- The 14-year-old Edgerton girl charged in connection with the overdose death of a Town of Milton teen will spend up to three years in a juvenile correction facility.The girl, who was charged with first-degree reckless homicide, appeared in Rock County juvenile court on Thursday and admitted to stealing prescription drugs that lead to the death of 13-year-old Alex Aiken, who fatally overdosed on oxycodone on Feb. 9. She was charged with first-degree reckless homicide.The girl will be sent to at the Southern Oaks Juvenile Correction Facility. Both the district attorney and defense lawyer agreed to enroll the girl in the Serious Juvenile Offender Program, requiring up to three years at a corrections facility and two more years supervision. The girl will serve the maximum penalty allowed in juvenile court.Prosecutors and the girl's defense attorney both said that her sentence offers the best chance to turn her life around."She is just barely 14 years old herself. This was a friend of hers who died. (She) did not want her friend to die," said public defender Kelly Mattingly."She (is) going to have lots of opportunities to learn the lessons. If she doesn't, she'll be coming back here, to this building, facing me and mine, and looking at a lot more serious consequences down the road. And I pray to God she doesn't," said Rock County District Attorney David O'Leary.This teen was already heading down a dangerous road, according to Judge Alan Bates. She has been referred to the juvenile courts nine times and found delinquent three times. During the hearing, Bates said the girl had a history of using Ecstasy, mushrooms, marijuana and alcohol in addition to prescription painkillers -- all by age 14.She will receive treatment for substance abuse while being confined, officials said."The maximum penalty is appropriate. Her age justified keeping her in the juvenile system, because they have the best resources and ability to try to turn her life around," said O'Leary.Neither the victim's or defendant's parents wished to make a comment following the disposition hearing.However, Aiken's mother, Jenny Bethel, read a tearful statement during the hearing. She made it clear to the court and the girl that she feels the teen is responsible for what her family is going through. She told the court that no sentence the girl could receive would take her away from her mother, the way Alex was taken from her and her family.Earlier on Thursday, the girl waived her preliminary hearing and her case was moved back down to juvenile court. The judge, prosecutors and defense attorney all agreed that juvenile court was the best venue to try the girl. She had previously been charged in adult court, WISC-TV reported.The girl was accused of giving the stolen pills to two friends and both boys overdosed. Aiken was found by his mother when she tried to wake him up for school.The other boy, 13, also faces charges in connection with Aiken's death.
