Boy Found Not Competent To Stand Trial

A judge ruled Thursday that a 13-year-old boy accused of killing his father is not competent to stand trial.

Sauk County Circuit Court Judge Guy Reynolds said Thursday that Michael Crisafulli is incompetent to stand trial and he will be placed in the state's mental health system.

The judge based his decision on a competency exam, which concluded that aspects of the teen's autism spectrum disorder make it impossible for him to understand the criminal proceedings.

"The defendant, I find, is not competent to proceed. Both examiners conclude that Michael is not competent," Reynolds said. "At the very least, the defendant must be able to understand the essence of the charge -- first-degree murder -- the defenses that are available, and the essentials of the criminal proceedings. The defendant does not so understand."

The boy is accused of killing 55-year-old Angelo "Nick" Crisafulli in January in the family's rural Town of Delton home after he got into trouble at school.

Crisafulli will be placed in custody at a mental health facility indefinitely, WISC-TV reported.

He will return to court if doctors ever determine he is ready to be released back into the public.
