Zimmermann Family Seeks To Settle Lawsuit

The family of slaying victim Brittany Zimmermann is trying to settle its lawsuit against Dane County.

The mother and father of Zimmermann are asking the county for $150,000 to settle their wrongful death lawsuit, WISC-TV reported.

No decision on the offer has been made.

The settlement offer, just under $50,000 each for the estate of Brittany Zimmermann, the mother and the father comes seven months after the family filed the lawsuit.

The lawsuit alleges that negligence on the part of the county, the county executive and a then-911 call center operator led to their daughter's 2008 death at her downtown Madison apartment.

The 21-year-old University of Wisconsin-Madison student was engaged and pursuing medicine when she was found stabbed and strangled.

Zimmermann used her cell phone to call 911 for help sometime before she died, but the call was disconnected and police were not dispatched.

The 911 call has yet to be released.

Former 911 dispatcher Rita Gahagan and Dane County are current defendants in the lawsuit.

Several claims against Dane County Executive Kathleen Falk and the county over not correcting 911 Center deficiencies were thrown out in June. Also thrown out was an emotional distress claim filed by Brittany Zimmermann's former fiancé.

Eileen Bruskewitz, Dane County supervisor for District 25 and a past critic of Falk's leadership on improving the 911 Center, said the $150,000 offer is "a very small amount" and "if that's what the Zimmermann family needs and is willing to accept," the county should pay it.

The Zimmermann family did not return phone calls to WISC-TV Thursday.

The county executive's office said Thursday it had not heard about the offer and had no immediate comment.

Dane County's corporation counsel said she just learned of the offer late Thursday and has not received a recommendation from the county's insurance company on whether to reject or accept the offer.

A private attorney working for Dane County said a decision on the offer will be made in the next week and a half.
