A Wisconsin appellate court has reversed a judgment requiring home improvement chain Menard Inc. to pay a former executive nearly $1.2 million in pay and attorney fees.
Dawn Sands was fired as Menard's general counsel in 2006. She sued for discrimination and a circuit court determined she was entitled to more than $1.7 million in pay and punitive damages, and should be rehired.
The Wisconsin Supreme Court ruled Sands shouldn't be rehired and returned the case for lower-court action, where the award was lowered.
The 3rd District Court of Appeals ruled Tuesday the circuit court erred in calculating Sands' attorney fees, and the judge didn't consider enough evidence in deciding the pay award. It sent back the case for further proceedings.
Sands' attorney did not immediately return a phone message.
