A recent court decision in Dane County could affect the way Wisconsin landlords are able to evict tenants.
Some landlords let their management companies sue for evictions. But state law requires that evictions cases be filed by "a person entitled to the possession of real property." Some legal experts say that means only the landlord can sue.
A Wisconsin State Journal report said a Dane County judge recently agreed. He dismissed eviction actions against a man whose family was sued by a management company instead of the landlord himself.
Jay Koritzinsky, a Madison attorney who represents landlords, said many landlords don't have the legal expertise that their management companies have. He said landlords who handle cases themselves will have to hire lawyers, driving up rentals costs.
